Scope: Advised and provided legal support to arbitrator hearing claims and counterclaims of owner and general contractor involving the cancelation of the original $360,000,000 contract awarded for the project.
Resolution: Arbitration successfully resolved, with both parties supporting the decision of the arbitrator.
Project: Construction of new car rental facility at one of the largest airports in the U.S.
Scope: Preparation / negotiation / mediation of $28,000,000 delay, productivity loss and scope change claims of general contractor and defense of related $13,000,000 in counterclaims asserted by subcontractors and owner, along with associated insurance claims.
Resolution: Successfully negotiated resolution to all issues and obtained payment on behalf of the general contractor.
Project: Construction of large municipal wasterwater treatment facility.
Scope: Represented completion contractor in connection with $50,000,000 dispute between original contractor that was terminated and municipal owner.
Resolution: Owner / original contractor dispute settled. Completion contractor not drawn into the dispute and avoided participation in discovery.
Project: Construction of new distribution facility.
Scope: Represented general contractor in connection with insurance claims arising out of the serious injury of a subcontractor and $25,000,000 tort claim asserted by injured employee.
Resolution: Successfully resolved all claims through claim preparation, mediation and negotiation..
